Public Space Protection Orders (PSPOs)

Public Spaces Protection Orders (PSPOs) enforcement

PSPOs can be enforced by officers working for or designated by Elmbridge Borough Council, police officers and Police Community Support Officers (PCSOs).

Penalty for breaching a PSPO

Breaching a PSPO, without reasonable excuse, is a criminal offence. Enforcement officers may issue a fixed penalty notice of £75 for a breach of a PSPO, or following a non-payment of a fixed penalty notice to prosecute for the original breach, or where the breach is a repeated breach, to prosecute.  A person prosecuted for a breach of a PSOP is liable to a fine of up to level 3.
