Public Spaces Protection Orders (PSPOs) enforcement

PSPOs can be enforced by officers working for or designated by Elmbridge Borough Council, police officers and Police Community Support Officers (PCSOs).

Penalty for breaching a PSPO

Breaching a PSPO without a reasonable excuse is a criminal offence.

If you break a PSPO, an enforcement officer may:

  • issue a fixed penalty notice of £75
  • prosecute you for the original breach if the fine isn’t paid
  • prosecute you if it is a repeated breach

If you’re prosecuted for a breach, you could be fined up to level 3.
