New permitted development rights for blocks of flats

Last week it was announced that the government will introduce new permitted development rights allowing two-storey upwards extensions to blocks of flats from 1 August 2020.

What the new rules mean

The new rules will:

  • Allow the construction of up to two storeys to create new flats on the top storey of a building. The building should not be more than 30 metres high after the extension. 
  • Apply to an existing purpose-built, detached block of flats, built between 1 July 1948 and 5 March 2018.
  • Require developers to get prior approval from the council, but do not require a planning application 

Unlike planning applications, we will only be able to consider criteria set out in the regulations.
