Taxi (Hackney Carriage) drivers and vehicles are licensed under the Town Police Clauses Act 1847 and the Local Government (Miscellaneous Provisions) Act 1976. Private hire (mini cab) operators, drivers and vehicles are licensed under the 1976 Act (adopted by the Council with effect from 1 May 1979).
Drivers are issued with an identification badge and there is also a requirement to display an identification plate on the back of a licensed vehicle. In Elmbridge the identification plate is blue for Hackney carriages and red for private hire vehicles.

Note: Taxis usually charge according to their taxi meter but in some circumstances can agree a set price for a journey booked in advance. Taxis don't operate from business offices so their addresses are not given.
Hackney Carriages (or taxis) which have a sign saying 'taxi' can be hired from ranks without prior booking.
Minicabs (private hire cars) do not have a taxi sign and must by law - and for important safety reasons - be pre-booked, and therefore cannot be hailed.

It should be noted that subject to adequate insurance provisions any Elmbridge taxi or private hire driver is entitled to drive any taxi or private hire vehicle respectively. Although it is generally the case that vehicle licence holders are also licensed drivers this is not a legal requirement. For example a private hire company could hold a licence for a vehicle which could be driven by any individual from a pool of private hire drivers.
All taxi driver licences are dual entitlement and permit the holder to drive private hire vehicles also.
