Tree Preservation

treeLocal planning authorities have a statutory duty to preserve trees which contribute significantly to the amenity of an area, and written permission is required from the Council to remove or carry out surgery to any trees so protected.

The Council has made over 650 tree preservation orders which range from the protection of individual trees to area orders covering several hectares of land, and processes some 200-300 applications and notices for tree works each year.

|Trees within conservation areas - The designation of a Conservation Area provides protection to trees within such areas even if they are not the subject of a Tree Preservation Order.

A free guide to Council policy and procedures for the preservation of trees. It covers the making of tree preservation orders; applying for permission to carry out tree works; exemptions for dead and dangerous trees; the penalties for unlawful tree surgery; the notification of tree works in conservation areas; the regulations governing removal of important hedgerows; and includes an explanation of some arboricultural terms.

|Standards for the assessment of Arboricultural Amenity Supplementary Planning Guidance (SPG)
The purpose of producing this document is to enable the basis for making decisions on which trees to include in TPOs to
become transparent. It sets out the procedures used to demonstrate that the approach is consistent and can be reconciled
with current legislation and best arboricultural practice.

|Protected trees: Guide to tree preservation procedures
A Government leaflet written for the benefit of tree owners, the general public and amenity groups which answers the most frequently asked questions about tree preservation procedures.

|Tree preservation order appeals
The leaflet is for people who have applied to their local planning authority to fell or prune trees that are protected by a tree preservation order. It explains how to appeal to the Secretary of State if aggrieved by the outcome.
