Submission of the Core Strategy to the Secretary of State - March 2010

Following the Proposed Submission consultation the Elmbridge Core Strategy was submitted to the Secretary of State on 31 March 2010 for examination by an independent Planning Inspector, who will decide whether the document is legally compliant, sound and fit for purpose.

The representations received during the consultation were collated and summarised in the Regulation 30 (1) (e) Statement below. Full copies of the representations made can be viewed on our |online consultation portal or downloaded below. The Council has considered all representations and has produced a Schedule of Proposed Minor Changes. The Council does not consider that the representations raised any major issues which would delay the submission of the Core Strategy. Both documents have been submitted alongside the Core Strategy for consideration by an independent Planning Inspector. Further submission to the Inspector - December 2010

Since their election in May 2010, the Coalition Government made a number of changes to the planning system, including to National Planning Policy Statement 3: Housing and the revocation of Regional Spatial Strategies (RSS).

It was considered that these changes would have implications for the content of the submitted Elmbridge Core Strategy and that people should be given the opportunity to comment on the plan in light of the above changes. As these changes were made subsequent to the publication of the proposed submission Core Strategy in January 2010, the examination has been held in abeyance for six months to allow for this additional consultation, any changes to the plan to be made and the examination process to resume. The consultation took place between Monday 6 September and Monday 11 October 2010. The responses to the consultation have been considered and a schedule of proposed changes to the Core Strategy prepared. In addition, the Council has noted that on 10 November 2010 the High Court found that the decision of the Secretary of State for CLG, announced in a Parliamentary Statement on 6 July 2010, to revoke the Regional Strategies in place at that date as unlawful (Cala Homes (South) Limited v Secretary of State for Communities and Local Government [2010] EWHC 2866 (Admin)). An addendum to the Core Strategy has been produced to show that due regard has been given to the South East Plan in preparing the Core Strategy and appropriate weight given to the emerging localism agenda.
