Householder Appeal Service

The Planning Inspectorate launched a new Householder Appeal Service on 6 April 2009 for Householder applications that subsequently go to appeal.

The Householder Appeals Service( HAS) offers a simpler, more proportionate approach to the handling of householder appeals, so that determinations can be made quickly. These types of appeals will be decided within 8 weeks.

HAS is a procedure for householder appeals which proceed on the basis of written representations. Appeals against refusals on householder applications which the Planning Inspectorate has determined will proceed on the basis of written representations will be within the scope of the Householder Appeals Service.

This includes:

  • appeals relating to an application for development such as dwelling house extensions, alterations, garages, swimming pools, walls, fences, vehicular access, porches and satellite dishes (this list is not exhaustive);
  • appeals against the refusal of householder applications for planning permission, as well as refusal of any consent/agreement / approval required by or under a planning permission, development order or local development order;
  • appeals against a local planning authority's decision to refuse to remove or vary a condition or conditions attached to a previous planning permission for householder development.

The following appeals will not be within the scope of the Householder Appeal Service:

  • appeals against any grant of planning permission, consent, agreement or approval which is granted subject to conditions;
  • appeals against a local planning authority's failure to determine a householder application (i.e non-determination appeals)
  • appeals against Listed Building Consent or Conservation Area Consent application
  • appeals against lawful development certificate applications
  • appeals against enforcement notices
  • appeals against applications for advertisement consent

How will the new scheme change for the applicant?

For the applicant a number of changes have been made. These aim to make the whole process easier to understand, to take part in and allow you to receive a decision much more quickly than at present.

  • the period to appeal for refused householder planning applications will be 12 weeks
  • you will no longer need to send lots of documents, you should only send a copy of the planning application, the refusal notice and the appeal form setting out your full grounds of appeal
  • you are required to set your full grounds of appeal using the householder appeal form
  • the Inspector will look at your appeal afresh, having access to all of the other documents, plans and material submitted at application stage. These documents will be supplied by the local authority
