What is a Statutory Nuisance?
![]()
A very simple definition is "a legal term which has been developed over many years and has come to mean something which is stopping you from enjoying your land or property".
Common sources of a statutory nuisance arise from:
Am I being subject to a statutory nuisance?
The Environmental Health & Licensing Division rely on training and experience to decide whether a statutory nuisance exists. Many factors need to be taken into account and the circumstances of each case considered.
Some of the key questions you could ask yourself include:
- Am I being reasonable in my complaint?
- Am I frequently affected by the nuisance?
- Is the intensity of the nuisance such that it prevents me from enjoying my home and garden?
- Is my health affected by the nuisance?
Despite investigations the nuisance I suffer has never been witnessed, what can I do?
The law recognises that in certain circumstances this may be the case so, as an individual, you are able to '|take your own action'.
